I need an advice.

Last year, I petitioned for my husband to get his green card and I was in a rush to get the application in before the application fee shot up, so I forgot to make copies of all the documents being sent to USCIS. Now, the interview is next week and I don't have a few of the documents that they want us to bring. It says that if already submitted, I don't have to bring in those documents, but I've heard that sometimes the interviewers still demands them during the interview.

Is there any way of getting the documents from USCIS or is it lost forever?

We will have the interview next Thursday, 21st of February.

Hi All,

My wife is on her first year of OPT, she is masters in STEM so she is eligible for 17 month extension.

In-order to re-new her OPT she needs get herself e-verified. However, her employer said thay they are not registered for e-verify system.
My question is �
- Is it possible to renew OPT without e-verification, if yes how?
- What are options in that case if her employer does not e-verify?

Hi there.....Even I want to find out if I-131 (AP) can be RENEWED without paying the fee when I-485 has been filed with the new fee structure. The USCIS site has not mentioned anything regarding the renewal fee for I-131 in this case (whereas it is clearly mentioned for the EAD). Is there anyone who can share his/her experience of AP renewal without paying the fee?

No No No.

You are fine. You can continue to work in US on the approved I-797. In US visa is required only to enter into United States. Once you cross the customs and walk into US that VISA is nothing. There after everything is I-94. with I797 you got new I-94 and that reflects your status.

Greetings,
please advise what steps should be taken if I recieved the NL letter from KCC that I am selected for 2011 DV lottery.

I am in AOS in EB3 category, my H1B already expired, working on EAD.

My case number from DV lottery is very high (29***).
What should I choose - CP or AOS???
Should I fill and return back to KCC both forms - DSP-122 and DS-230 forms??? :confused:

I am getting ready to file for my 485. I have a problem, and I am not sure how to go about it --
My wife's birth certificate has her name listed differently than it is. The birth certificate has a temporary/pet name. Is there anything I can do now, in next 14 days, before I can file for 485? Will any kind of affidavit help?

On March 19, 2010, the USCIS announced revised filing instructions and addresses for applicants filing an I-131, the Application for Travel Document.

Beginning March 19, 2010 applicants will have to file their applications at the USCIS Vermont Service Center or at one of the USCIS Lockbox facilities.

If you file the I-131 at the wrong location, the USCIS Service Centers will forward it to the USCIS Lockbox facilities for 30 days, until Monday, April 19, 2010. After April 19, 2010, incorrectly filed applications will be returned to the applicant, with a note to send the application to the correct location.

Hi,

I missed to write my family name in I -94 and When I reached the SSN office to apply SSN, I came to know that the mistake to be corrected and I am advised to meet the immigration office.

Now I am planning to go back to India next month, If I apply for I -94 correction I will take more then 60 days to get the new I 94 and I have to attach the original I -94 along with I-102 form (form for I 94 correction).

So I can travel back to india without correcting the mistake in I 94 and without the orginal I -94.

My employer was planning on sponsoring me, and paying all the filing fees, but the deal was that I was going to pay the lawyer directly for the legal fees. I just found out from a second lawyer that technically we can't do that because it will drop my salary below the prevailing wage. Is there anything I can do to get around this, and still pay the legal fees? Is it completely against the law for me to pay them or is that just an "interpretation of the law"? The other possibility is my husband could pay the fees, but I don't know if that's allowed either.

Let me know if you have any advice - we have to have everything signed by this Friday.

I went on March 11. I went in for 10 am appointment and was out at 10.10 am. Fulltime, first time H1B stamping. Simple questions - where did I do my education, what do I do in my current job, then the officer asked for W-2s from last two years and that was it.

(1) I have applied my Labor Certification in February 2003 and It is approved in September 20, 2007. After almost 4 years. Now, my employer is ready to file I-140 by October 10, 2007. I am also in my 7th year of H1-B visa and it is expiring in August 24, 2008. I have heard that you need to have 365 days of time period between Labor Approval and H1-B renewal of VISA for 8th year. If my I-140 is still in pending stage until August 2008, still Will I be able to get my H1-B extension for 8th year? In reality, I am short of 60 days to finish the count of 365 days.

(2) On the other side, I may not have worry as my Labor was filed in year 2003.

Any Clarifications?

Here's my case
(EB3-I I485 filed & pending, got married after July 2007 episode and missed filing I485 for my wife.)
So, cannot use EAD during these transitions and continuing H1 filings & extensions...

My current H1b is expiring on Sep 30 2010, I 94 expires on Oct 09 2010 (I know the officer at DFW POE was kind enough to give expiry 10 days beyond petition exp date).
My current company filed for normal extension during 3rd week of Sep 2010.

Now I got job offer from another employer, who wants me to join from 11 Oct 2010 or I can ask them to advance joining date to 06 Oct 2010 (to rule out the possibility of being out of status). They are ready to do H1B premium. (They claim their track record is good, & they get very minimal denials)

Did anyone face this situation?
Also, once the new employer's H1B is filed, does it come with I-94 cards in the petition notice? (If not, I would have to go out & get stamped, don't I?)

Hi There,
My 485 application is pending at TSC on EB3 category, country of chargebility is Inida. Yesterday my PERM labor approved on EB2 category and need to apply 140 to recapture my own EB3 PD.

My employer will come under NSC. if the PD recaptured, I will be hardly one month away from my priority date to be current, as per the current visa bulletin dates.

1) So can you please provide some suggestion to which Service Center will be opt for filing EB2 140 now, in order for getting an optimal or faster process for 140 and eventually 485?

2) Does the service center really matters as it will take a very long time for me to get greened?

3) Is it worth waiting for couple of month's visa bulletin, to see whether the EB2 I dates are moving so that I can use some streamline process to process 140 and 485 together?

One think people don't get is, whether the current/future job qualify for EB2, It doesn't matter even you have a Phd and the job only requires Bachelor or equivalent then it is EB3, also certain programming jobs doesn't qualify for EB2. First ask your HR for min job requirement!:(

The AC21 determination of whether a new job is in "the same or similar occupation" is made based on a comparison of the new job duties and those set forth on the original labor certification application. Job titles are not controlling. So, you need to have a copy of your original LC application and then compare the job description it contains to the duties of the new position.

gcformeornot is correct. You cannot "transfer" an I-140 approval, but you can keep and use the PD for any subsequent I-140. Once a new LC is approved, a copy of the I-140 approval notice with the 10/2007 PD should be included in the new I-140 submission along with a request to use the old PD on the new I-140 approval notice.

As per my knowledge, You will be out of status if you didn't your H1B approval.
So you should try alternative things, like moving on to F1 or H4 dependent Visa.

If you have EAD you should not worry at all.

About USCIS, sometimes it won't get updated. One of my cousin's H1B was canelled and compant got confirmation mail, But still his status shown as active from past 1 year. Make sure with your Employer (ABC/initial company who has your h1B upto Feb-2011) that they got letter from USCIS.

Hi,
Just wanted to get some feedback whether its possible to get i-140 approved using an old approved labor ?

- Case:EB3 ROW.
- The company A merged with B. (may be a successor-in-interst)
- Labor from B approved in 2005 w/pd=2005
- Labor from A approved in 2006 w/pd=2002.
- I-140 using 2005 LB approved with B
- Lawyer suggests to use the A's 2002 Labor to file a new i-140 under company B. He says that as per some law the old labor is still valid until end of this year. Please advice.

Yesturday night, I saw Charlie Rose Show, in which he first interviewed Andi Carr and then RAHM EMANUEL Representative (D-IL)....
In the middle of conversation, Charlie asked Rahm about what Dems agree and disagree and how they will work with President. He replied that there is no all disagreement. He said Dems agree on Tax reform as well as Immigration. Then he went on to talk about favoritism to CIR.

It seems like winning the election even while being on Immigration side as well defeat of Representatives J.D. Hayworth and Randy Graf (Hardcore Immigrant Haters) have embolden Dems that Immigration is not as taboo as it was once thought. I have a feeling that they will get this done sooner than later. :)

Hello,

It seems that I made a mistake in my DS-160 and my H1B got stamped with an error in my middle name. I repeated my lastname as my middle name so my full name appears as: 1stName 1stLASTNAME 1stLASTNAME 2ndLastname

I have a Tourist Visa also stamped wich is OK. Also the data on my passport.

My I797 is OK and everything else is OK.

I am still in my home country. Should I be worried about it? Should I try change it here or in the US?

In any event, what's the correct procedure to change it?

Nikon is taking their time with this one, as they're taking their time with the WT-3 transmitter for the D200. I am interested, but by now I've invested a bit too heavily in a DNG-based workflow by converting everything to DNG and attaching IPTC metadata, to consider Capture NX as a serious contender for my workflow. Though, I do imagine that I'd use it for those rare times when I need a really high quality conversion for very large printing.
