    I emailed them not as me but as my employer( point of contact mentioned in the labor petition) and it works they send me a copy of the labor approval to my house along with a copy to my employer and one to my attroney. It really works.

    Skilled legal immigrants from all over US will rally peacefully in Washington DC on Sep 18 at 9:00 AM. The rally wants to draw Congress's attention to 10+ year delays in skilled employment based (EB) immigration. The rally is being organized by Immigration Voice (http://immigrationvoice.org), a non-profit grassroot advocacy group of skilled EB immigrants from all countries.

    It takes 7+ years (after 2+ years on student visa followed by 1 year on practical training) to become a resident. Some of these immigrants have returned to their countries (or gone to other countries) causing reverse brain drain: educating immigrants on tax payer dollars to compete against the tax payers. There are 1+ Million immigrants in EB immigration process.

    EB immigrants have patiently waited 2+ years with focus on every other kind of immigration reform. This is inspite of the fact that EB immigration has the simplest solution: increase EB immigrant quota and streamline EB immigration process.

    Skilled EB immigrants are scientists, engineers, business administrators, health care professionals, ... These immigrants are college educated but also have US MS and US PhD.

    EB immigrants have generated millions as Visa Education and Training Fee (http://www.bibdaily.com/pdfs/CRS%20H1B%20fees%20Jan%202007.pdf) (through visa application fee) and contributed billions to Social Security System (http://www.aila.org/content/default.aspx?docid=12396).

    Since on 2nd July they said they will reject the AOS application, what if they would have done some rejection during that time, and by the time July filers get their application back, it is after 17th of August. In that circumstance, can you send the AOS application back arguing USCIS's mistake and ask them to take it back after 08/17 and would they take it back politely or reject it again.

    My wife works in a company where a good number of IT folks are staffed by INFY. The poor quality of work made the company think about not extending INFY's contract. But then it came out in the open that there was no documentation on how the applications were built, etc. INFY got wind of this, and now they have positioned themselves in the organization where without them, this company's IT would collapse.

    There are many such stories of outsourcing firms that are holding client companies hostage. Though I do not agree with the bill, I think the bill brings back some ethics into play. Especially the L1 loophole.

    I squarely blame it on the company for not requiring INFY to document everything. There is such a thing as process or quality control. They have painted themselves into a corner. Having said that, companies will take advantage of this situation. Its just plain business...

    I consider FOIA is a multifold success. Not only we achieved milestone 1 of $5K, we were successful enough to wake up members to do something after long time. Why do you think the very same members were sleeping? I don't believe IV Core was not doing anything in last few months but members always felt that there is no plan of action from IV. There is nothing worst could happen to us just by disclosing our plan of actions in controlled way like:

    1. <<ABC>> is preparing document for final data information.
    2. <<XYZ>> is evaluating other options how we could retrieve this information.
    3. <<DEF>> is understanding how FOIA works and how long it will take us to get data and what will be the best option to get it earlier.
    4. <<MMM>> is working on funding drive for this.

    There is no reason to hide even this kind of information. But if we do this, members understand what we are doing at high level.

    My 2 cents.

    Building a Wall Against Talent

    PALO ALTO, Calif. -- Fifty years ago, Jack Kilby, who grew up in Great Bend, Kan., took the electrical engineering knowledge he acquired as an undergraduate at the University of Illinois and as a graduate student at the University of Wisconsin to Dallas, to Texas Instruments, where he helped invent the modern world as we routinely experience and manipulate it. Working with improvised equipment, he created the first electronic circuit in which all the components fit on a single piece of semiconductor material half the size of a paper clip.

    On Sept. 12, 1958, he demonstrated this microchip, which was enormous, not micro, by today's standards. Whereas one transistor was put in a silicon chip 50 years ago, today a billion transistors can occupy the same "silicon real estate." In 1982 Kilby was inducted into the National Inventors Hall of Fame, where he is properly honored with the likes of Henry Ford and Thomas Edison.

    If you seek his monument, come to Silicon Valley, an incubator of the semiconductor industry. If you seek (redundant) evidence of the federal government's refusal to do the creative minimum -- to get out of the way of wealth creation -- come here and hear the talk about the perverse national policy of expelling talented people.

    Modernity means the multiplication of dependencies on things utterly mysterious to those who are dependent -- things such as semiconductors, which control the functioning of almost everything from cellphones to computers to cars. "The semiconductor," says a wit who manufactures them, "is the OPEC of functionality, except it has no cartel power." Semiconductors are, like oil, indispensable to the functioning of many things that are indispensable. Regarding oil imports, Americans agonize about a dependence they cannot immediately reduce. Yet their nation's policy is the compulsory expulsion or exclusion of talents crucial to the creativity of the semiconductor industry that powers the thriving portion of our bifurcated economy. While much of the economy sputters, exports are surging, and the semiconductor industry is America's second-largest exporter, close behind the auto industry in total exports and the civilian aircraft industry in net exports.

    The semiconductor industry's problem is entangled with a subject about which the loquacious presidential candidates are reluctant to talk -- immigration, specifically that of highly educated people. Concerning whom, U.S. policy should be: A nation cannot have too many such people, so send us your PhDs yearning to be free.

    Instead, U.S. policy is: As soon as U.S. institutions of higher education have awarded you a PhD, equipping you to add vast value to the economy, get out. Go home. Or to Europe, which is responding to America's folly with "blue cards" to expedite acceptance of the immigrants America is spurning.

    Two-thirds of doctoral candidates in science and engineering in U.S. universities are foreign-born. But only 140,000 employment-based green cards are available annually, and 1 million educated professionals are waiting -- often five or more years -- for cards. Congress could quickly add a zero to the number available, thereby boosting the U.S. economy and complicating matters for America's competitors.

    Suppose a foreign government had a policy of sending workers to America to be trained in a sophisticated and highly remunerative skill at American taxpayers' expense, and then forced these workers to go home and compete against American companies. That is what we are doing because we are too generic in defining the immigrant pool.

    Barack Obama and other Democrats are theatrically indignant about U.S. companies that locate operations outside the country. But one reason Microsoft opened a software development center in Vancouver is that Canadian immigration laws allow Microsoft to recruit skilled people it could not retain under U.S. immigration restrictions. Mr. Change We Can Believe In is not advocating the simple change -- that added zero -- and neither is Mr. Straight Talk.

    John McCain's campaign Web site has a spare statement on "immigration reform" that says nothing about increasing America's intake of highly educated immigrants. Obama's site says only: "Where we can bring in more foreign-born workers with the skills our economy needs, we should." "Where we can"? We can now.

    Solutions to some problems are complex; removing barriers to educated immigrants is not. It is, however, politically difficult, partly because this reform is being held hostage by factions -- principally the Congressional Hispanic Caucus -- insisting on "comprehensive" immigration reform that satisfies their demands. Unfortunately, on this issue no one is advocating change we can believe in, so America continues to risk losing the value added by foreign-born Jack Kilbys.

    Its high time for us who are already in US in H1 and struggling to get green card, as I know the tend to come to US in new college grads from India are reduced now..which is a good sign for India and bad sign for this country..now we are the ones who are in middle of ..
    and these morons don't even try to solve the real problem, they should ban this H1 Visa program if this was so badly abused..this is all for vote bank..

    dont forget the fact that EAD and AP are issued for 12 months, you have to renew each year. It is recommended that you apply for EAD/AP renewal at least 180-90 days in advance to prevent periods where your current EAD has expired while you wait for the renewed one...welcome to the new nightmare, someone did say something about the grass been green on the other side..now that we are on the other side we wait for 485 to be current while we renew EAD/AP each year, fingerprint every 15 months and aviod the namecheck black hole...maybe this is what they(uscis) wanted after all...a steady income stream...good luck :)


    July filers SCREAMED for the right to simultaneously file after the government realized they had to reneg on their bulletin precisely because they could NOT cope with these numbers. AILA screamed that it had to do it or they would sue.

    Well it's done. Happy now?

    Perhaps with a little luck, they will again introduce interim EADs from local SA offices. Keep your fingers crossed.

    Just to let u know, during my H1 processing, my H1 was thrown back to my lawyer asking them to send photographs of my workplace and co-workers, server room, my desk. I had to use an entire disposable camera for the same. To make things even funnier, i was not even the First one to be on H1 in my company. We had atleast 7-8 H1's at one point in time. The reason given for a throw back was, that this company seems quite new and small.

    I know this is off topic, but since someone has raised this point albeit in jest, i thought i should let people on here know that UCSIS has it's own whims and fancies at times. So if something similar has happened to you in the past know that you may not be alone. :)

    Yes this is wierd!!
    What if the company is small and is a startup! As long as the employer is willing to pay the salary at prevaliling wage, USCIS should approve the case. Even large companies start as small and such small companies need high skilled US educated immigrants to innovate and grow the business. This is a problem not just with H1B applications but with green card applications. I am sure other people would have faced this situation when they filed their GC application through a small company with low annual income.

    Are u sure that "http://mumbai.usconsulate.gov/cut_off_dates.html" is not any error ?

    If yes! How come china status is not indicated explicitily as is indicated in travel.state.gov?

    Does any one have previous month cut off date from this site ?

    I think you are wrong. When the application is entered into the system that date is called Notice date. Receipt date would be the date USCIS recieves the application.

    Receipt date is not the date when the application reaches the service center. It is infact the date when your application is entered into their internal system which could be several days after the application has reached the service center.
