    Nitinboston is right. He is not saying that we do not deserve it. Just saying that we should not behave that we are entitled to it. The Govt did not promise that one will get green card in X years...and broke that promise. Yes, the system is flawed and all sorts of people get ahead in line..and some get stuck.

    However, this crazy rants critizing the country where we want to settle down is a bit hypocritical. If you hate so much...please leave...its a choice.

    Once again, I am not saying we do not fight for improvement..and better quotas..better visa allocation (and more of them). But let us not behave like bad guests.

    I am personally suffering big time despite being in the country for 10 years..and will support initiatives. But I will not behave like as if I have been wronged. If one feels so wronged..please pack up and leave. If you think you have been cheated of your social security...by all means...please go to a country where you can earn more money and keep all that.

    Once all of us become citizens...we will then start wondering that our jobs are being taken away by new immigrants..and the cycle continues........

    Not Volunteer but Leaders...

    Volunteer is a person who takes responsibility and does a task. Here the question was raised to have new leaders who can take a flight to Washington DC on Monday morning, change the law by noon to issue GC to every EB category, have a lunch at Olive Garden, come back monday evening.

    oh that's easy stuff - I can do that :p sign me up. I love chicken parmesan at olive garden. There is just one problem. What do you want me to do after my lunch and before my evening flight. That's just waste of too much of my time. :rolleyes:

    Boxer , Feinstein senators of CA , I called Lofgren , Gary miller (R) 42nd district of CA and Just spoke with NYtimes reporter on the follow up story ...:)

    I already done that yesterday evening: Today I talked to both offices. Yesterday I just sent web form (E-Mail)... I could not speak to senators personally as both were unavailable but I spoke to their office staff and both have listened me and have guranteed to make sure this reaches to senator's eyes and ears.

    Hi Hebron,

    I have filed EB2 & EB3 with the same company (As explained earlier). EB3 as Programmer Analyst and EB2 as Database Adminstrator ( MS + 2 yrs exp.). I think it is better to take some expert attorney advice on your case. It does not hurt if you consult ( or crosscheck ) with some other attorney about your case. Most of the legal experts charge around $250 to evaluate your case and suggest.

    Where is my Ellis Island?

    America is more than a country. It is an idea. It is the idea of freedom, liberty and justice for all. It is the idea that an immigrant with the determination, skills and the ability to work hard can make it. He or she can single handedly change the course of their generations to come.

    I first read Jeffery Archer's Kane and Abel when I was 13. One of the most powerful images that the book conjured up for me was the day young Abel Rosonovski after facing years of hardship and seeing the collapse of the Polish dynasty, manages to get to America. Archer describes is great detail how Abel looks at the Statue of Liberty with tears in his eyes. When he lands on Ellis Island there are two guards who make notations of everybody getting off the boat and following a medical exam he is welcomed into America. Not as a temporary worker, not given an H1B, not given a temporary asylum status, but is welcomed as a full fledged American Citizen into the United States of America.

    Today, things are not the same. I agree that I did not have to endure years of civil war or ethnic strife, but my reason for moving to the US was just like every American's grandfather, great grandfather or great-great grandfather. In essence it was to ensure a better life for me and for my future generations. My great grandchild will someday talk about how her grandfather moved here, put himself through graduate school and tried to build a better life. Her story will be the same as every other American's.


    However, today I saw a letter being circulated by the anti immigration groups asking their congressman to oppose a bill proposed by Rep. John Shadegg of Arizona. This bill provides relief to millions of us who are stuck in limbo because of the worst set of immigration policies for educated immigrants in the civilized world. What makes me rethink my American dream is not that restrictionists like Lou Dobbs are against this bill but because what is being circulated is plain lies.

    They claim that persons on H1B does not pay taxes, bring in millions of family members and produce thousands of “anchor babies.” This is the same set of lies being touted by Tancredo and his creed. Under the H1-B visa we are not exempt from any taxes that are charged by the IRS. In fact most sensible and informed law-makers have agreed that this is almost discriminatory because under a work visa we cannot avail of any benefit that the social security program provides for.

    The other thing that makes me question my decision of being in America is the anchor babies’ statement. This statement reeks of xenophobia. It goes against everything that this country stands for. It is a slap in the face for the drafters of the 14th amendment. If my baby is an anchor baby, then every single American is also an anchor baby. By calling American children of immigrants "anchor babies" these restrictionists have defiled the entire premise of America. In immigrant circles, where people understand the process of immigration, this is seen as the "maccaca" moment for organizations like Numbers USA.

    Its time the restrictionists and the American public decide once and for all what they want from the immigrants. If you do not want us here, provide Tancredo and his creed with the tools to go ahead and build a mile high wall on the southern border, eliminate all temporary visa programs and close down any legal avenues for people to come here.

    If you consider that we provide value, subsidize your taxes by paying into the Social Security program, are an important part of your community and that we help stimulate the economy through taxes and buying power, then provide Rep. John Shadegg with the power to pass the Skill Bill.

    In any case end our misery and let us know what you want. This way we can go about our lives.

    bkn96, Thanks a lot for this information.

    Guys, I was just wondering whether we can talk to Ron Gotcher/Greg Siskind to take up our case with AILA or USCIS. Ron Gotcher seems to be very very unhappy about this wrong doing of USCIS. Any suggestion?

    Someone pointed that AILA recently discussed this issue with cis, and rule is still under development. There was a link posted to a PDF somewhere on this/similar thread. I will try to find and post a link here!

    Don't we need the consent of the petitioner (employer)? Please see the line item # 15.

    Yes, you will need the consent of your I-140 petitioner (employer) to send this form. So there is no point in sending the form, if you cannot get your employer to sign it. Basically, its an employer petition and hence Ombudsman's office their consent to assist you.

    Here is how I came up with that analysis. Last year they made changes to give GC for those stuck in FBI name check if they passed 180 days. So most of the ROW got their GC last year. There were not many labors approved from 2008. So there is no demand from EB2 ROW this year. With the economy going down, not many would get EB1s either. I don't anticipate many EB5s either this year. So major chunk of EB visas will need to come to EB2I/C. Will CIS do that or not is a different story.

    i dont agree with you, These things are against the law.

    1)
    All we need is a recapture. Lets concentrate on the bills in congress and senate and get them passed. This needs very less effort than what you prescribed.
    2) If 1 fails,
    There is no descrimination as such, this is more of a outdated law and bureacratic delay caused wastage of numbers, lets fight it in legal system. Some asylum case won against wastage, why not ours? We have big numbers, If everyone can contribute, this will happen. Hire the same lawyer and am sure he/she wont charge more than what(if any) they charged to an asylum case....

    Many have organized into a grassroots organization called Immigration Voice and are planning a pro legal employment based immigration rally in Washington DC on Sep't 18th. We would appreciate coverage of this first of a kind event which puts the spotlight on a just cause which for far too long has gone ignored by our lawmakers.

    Here is the scoop.

    from US Congresswoman's office, an immigration specialist spoke to their liaison at the Nebraska Service Center.

    Liaison confirmed the following:

    1. I-140 approval in September, 2007 (actually 09/04/2007 as I have the hard copy)
    2. I-140 revocation in Feb, 2009 ( he has not provided the day of the month, but from LUD I have it strongly pointing to 02/03/2009)
    I have not told the Congresswoman's office about the I-140 revocation. Just mentioned that it might have happened as I have left the company.

    3. Liaison did confirm that even after the I-140 being withdrawn I am eligible for adjustment thru AC21.

    4. Liaison did agree that if the I-140 was revoked within the stipulated time given in AC21, Nebraska’s decision to deny the I-485 may have been in error. (which in my case is true)

    Immigration specialist at the Congresswoman's office is going to contact the Director of NSC to review this matter with a supervisor

    Unanswered questions:

    1. If the Liaison can see that my I-140 is approved on 09/04/2007, why is that the adjudicating officer is responding with a denial on 09/04/2007 and subsequent denial of I-485?
    2. Are they both not looking at my information with same interface?

    Conclusion:
    Atleast in my case it looks deliberate and intentional.

    One my friends got his wife's AP approved by scheduling an appointment with local InfoPass office. but you need a valid reason and proof for that. In his case he got his father in law's medical certificate from India.

    When your friend went for INFOPASS, did he get a single copy of the AP, or two copies of the AP ?

    I want to know if there is a difference between getting APs through mail or INFOPASS.

    gimmeliberty, srinivas_o, x1050us, PKV4voice thank you so much. I was out for about a couple of hours and when I came back I saw all these contributions lined up. I cannot express the feeling I got. I was totally overwhelmed. After yesterday’s round, which took about 24 hours to close (estimation, I didn’t check), I was worried if we will be able to finish this round. But I am certain now that we will finish this round successfully. Of course, we will, if we have motivated people like you.

    I am in EB2 with a US Master's degree. My priority date is April 2006 and my case is not approved. Many of friends same boat as me are not approved.

    So "reddymjm" I don't think all US Master's degree in EB2 are approved.

    I meant most of the approvals are US Master Degrees.

    I don't know why they updated us so fast with in a week on this.

    May be because they are not expecting to enter the July applications in the system (or just uptill July 2)
