    When do you think would EB2-I hit Feb 2005? Before this year end?

    Perhaps not. With many I140 getting approved, there are always chances of dates going back instead of moving forward.

    I can think of average movement of one or two months moving forward per quarter. The two bills in pipeline can ease this situation:

    2. Recapturing of unallocated GC Visas

    I do not know if USCIS is going with receipt date or any procedure. My Receipt date is June 27, 2007. Notice date is August 9, 2007. My case is not touched either till now.

    As far as I remember, I (from California) was able to renew the license by mail. I did not have to go to DMV. So, these issues about I-797/I-94 needed for DL, are they coming up during a new DL or during renewal of license?

    Howz DL procedure in CA for 485 guys? I do not have H1B any my I-94 expired long time back. I have out of state licensce that expires in 2011 only. If I want to take CA DL, will it be a easy process? For how many years they give DL for 485 guys?

    I am of the opinion that the dates might retrogress to somewhere in 2005 June as the worst case (by Oct-Nov), because the 05 numbers should really be low to start with due to PERM issues. Again this is just my educated guess.

    USCIS (processes immigration petitions after completion of labor certifications and processes green card applications for applicants in the United States); and
    DOS (establishes priority dates and processes immigrant visas from applicants outside the United States).

    My question is, is IV paying enough attention to this?

    What I have seen is that IV is spending 80% of its energy to change the current immigration law (increase the EB visa numbers in some fashion etc.). As far as I can see, this is not going any where due to a variety of reasons.

    Is it time to rethink our priorities? If we put more of our collective energy to force USCIS to do a better job, will we get better results? Sure, the immigration law needs fixing. But our predicament is not due to immigration law. Our predicament is that the USCIS is not doing a good job. They are only working 4 hours a day. (I saw a post from a person who went and looked around the USCIS parking lot on a Friday :D. He/She says the parking lot was empty in the afternoon.).

    I suggest that the IV core spend 80% of energy in fixing the USCIS bottleneck. We should have another rally infront of the USCIS doorsteps (or a flower campaign or a card campaign or a degree copy sending campaign). 20% of the energy can still be spent on fixing immigration law.

    There seems to be 2 different opions about the process after CIS has received hundreds of thousands of applications until Aug 17th.

    1. Once received, CIS cannot sort out the applications according to PD, so only RD is important.

    2. PD is still an important factor, so if CIS is stuck with tons of applications on their hand, they will prioritize them by PD, which means if you have PD Dec 2004 and RD Jul 25 2007, you will be approved earlier than someone with PD Mar 2005 and RD Jul 2 2007.

    Greg Siskind, an immigration lawyer known to most folks here for his blog, says in his new FAQs that CIS should work on by PD.

    I think that's a fair thing, but I'm wondering how they would be able to sort out the flood of applications. Any idea?

    This would suck for older priority dates.

    My priority date is March, 2002!! Application was delivered to Nebraska on June 15th but the Receipt date is in mid-July.
    So all those filers with priority dates after me (did not come across any with PD older than mine) that got their receipt notices before me would jump ahead in line!! Who knows how many years more...

    Hopefully they will change their procedure after this fiasco to go by Priority Dates first and then the receipt dates.

    You should be happy as you have a very old PD.

    As u mentioned that you applied in mid june but the receipt date is mid july. What is your notice date? I thought that receipt date is the date when uscis receives your application. I may be wrong.

    Here is how I came up with that analysis. Last year they made changes to give GC for those stuck in FBI name check if they passed 180 days. So most of the ROW got their GC last year. There were not many labors approved from 2008. So there is no demand from EB2 ROW this year. With the economy going down, not many would get EB1s either. I don't anticipate many EB5s either this year. So major chunk of EB visas will need to come to EB2I/C. Will CIS do that or not is a different story.

    Contributed another $100. I am not very active member on this board but I do follow it regularly and I have made contributions in the past.

    Let me also take this opportunity to thank IV for putting legal EB immigration on the front page and its ability to galvanize the grass-root efforts in the momentum not seen before. I think we can only go forward from here and if we keep united, make regular contributions and fight for our justified cause, we can do wonders!

    I had an email conversation with my lawyer regarding 180 day portability.
    She said that the count for 180 days should begin with notice date for safe side.
    However the count begins with Receipt Date which is a day or 2 off from the actual application receive date (mail received date).
    This is what i got from my lawyer.


    Your lawyer is a wise person.. Although we know the count starts from Received date, we should plan with ND to be absolutely safe!
