    The state chapters don't seem to be very effective.
    I thought I was a member of the CA chapter but in the last few months I received no information from anybody in this chapter.
    I was semi-active, meaning I helped with phone calls, money and prints and that's as much as I could do at this point in time.
    And at some point there was a discussion about a new user group of only the people that are active and can contribute and it seems they went through with it.
    I understand that some things might be better discussed in a smaller group with the people that can dedicate more time, but there are different levels of commitment and if you're not open and accept that some want to help but can't do as much as others, you're cutting yourself short.
    When there is a big initiative or a push for funds and effort, you're not even reaching out to the bigger group; you're relying on the same small number of people and they too have limited resources and energy and will get tired.

    Maybe I’m just having a bad day but that was my experience and CA is one of the most active chapters so maybe all is well I’m an isolated case.

    Sometimes chapter leaders are unable to communicate the message to members on time or must be busy for their own reasons. We will note your feedback for future. Thanks.

    When a girl comes to US for a job as a nurse and starts earning a good salary. The parents try to get some money from her. they build good house to make a show. Once the money starts pouring in, the (brother)son wants to do some business, build a house, the relatives start. My wifes relatives (dad's sisters) called up for money. " you guys are earning good in US, we want to build a house. When can you send me couple of lakhs".
    I hate south indian nurses who came to US alone for jobs and more than that their parents who send them to earn money. I married a south indian nurse. The expectation from a daugther is more than a son because they tell their daughters once you become a nurse and go to US/UK or elsewhere i will start a business. "Our neighbour's daughter is in UK and they have a good house." Another great thing is once the girl is a nurse, guys come running to marry them and enjoy their life raising kids and the wife works at the hospital. I know several guys who got a green card through a nurse, works part time and take care of the kids. In that case the girl buys property at her dads house settles under her dad's wishes and should not do so when they married a person who earns the same salary as hers.
    I really don't understand the meaning of marriage if its like a slavery.

    My suggestion to those who are not married,
    Marriage is very good if both of them know their responsibilities. Before marriage know each other for more than 3 years then get married. talk about whats their thinking about marriage. IS she going to change her last name after marriage. This seems small but the surroundings make the life miserable after some years. How are you going to control the finances etc..
    As one of the old hindi dialogues, before marriage ... like moon(chand), after marriage .. like suraj (sun) and after having a baby - like a fire(juala).

    respecting policies and law is one thing.

    lack of a good implementation plan and improvement over a number of years is another thing.

    We can't just poke around an established government agency because we feel they are not doing their job properly.

    What do you (You refers to people who think above, not one in particular) say about the people who filed lawsuit and got the 180 day Name check rule to implementation faster? Not that I am proposing lawsuits, just an example to disprove what you said.

    I am trying to figure out what you guys are trying to say. If you guys think that CIS will give you the GC on the day they will feel like and you are cool with it, Why even hopping around boards either for information or anything. Just follow the processing times and see whether number has been called or not. 99% of the crowd thinks here that we can get a better policy by making our voice heard. I dont see rational and logic between what you are saying and what you are doing, unless you are smartly drawing a wedge or trying to scare away people saying that you are not a citizen, you will get busted.


    You are entitlted to your opinion and you are free to do and think what you want.. Remember, we are in America.

    I can understard D-E-D's frustration.

    I don't think there's much to say. That's what we say in Australia when things just keep on going around and around and around.

    Are Indians the Model Immigrants?

    A BusinessWeek.com columnist and accomplished businessman, Wadhwa shares his views on why Indians are such a successful immigrant group

    They have funny accents, occasionally dress in strange outfits, and some wear turbans and grow beards, yet Indians have been able to overcome stereotypes to become the U.S.'s most successful immigrant group. Not only are they leaving their mark in the field of technology, but also in real estate, journalism, literature, and entertainment. They run some of the most successful small businesses and lead a few of the largest corporations. Valuable lessons can be learned from their various successes.

    According to the 2000 Census, the median household income of Indians was $70,708�far above the national median of $50,046. An Asian-American hospitality industry advocacy group says that Indians own 50% of all economy lodging and 37% of all hotels in the U.S. AnnaLee Saxenian, a dean and professor at University of California, Berkeley, estimates that in the late 1990s, close to 10% of technology startups in Silicon Valley were headed by Indians.

    You'll find Indian physicians working in almost every hospital as well as running small-town practices. Indian journalists hold senior positions at major publications, and Indian faculty have gained senior appointments at most universities. Last month, Indra Nooyi, an Indian woman, was named CEO of PepsiCo (PEP ) (see BusinessWeek.com, 8/14/06, "PepsiCo Shakes It Up").

    A MODEST EXPLANATION. Census data show that 81.8% of Indian immigrants arrived in the U.S. after 1980. They received no special treatment or support and faced the same discrimination and hardship that any immigrant group does. Yet, they learned to thrive in American society. Why are Indians such a model immigrant group?

    In the absence of scientific research, I'll present my own reasons for why this group has achieved so much. As an Indian immigrant myself, I have had the chance to live the American dream. I started two successful technology companies and served on the boards of several others. To give back, I co-founded the Carolinas chapter of a networking group called The Indus Entrepreneurs and mentored dozens of entrepreneurs.

    Last year, I joined Duke University as an executive-in-residence to share my business experience with students (see BusinessWeek.com, 9/14/05, "Degrees of Achievement") and research how the U.S. can maintain its global competitive advantage (see BusinessWeek.com, 7/10/06, "Engineering Gap? Fact and Fiction").

    1. Education. The Census Bureau says that 63.9% of Indians over 25 hold at least a bachelor's degree, compared with the national average of 24.4%. Media reports routinely profile graduates from one Indian college�the Indian Institute of Technology (IIT). This is a great school, but most successful Indians I know aren't IIT graduates. Neither are the doctors, journalists, motel owners, or the majority of technology executives. Their education comes from a broad range of colleges in India and the U.S. They believe that education is the best way to rise above poverty and hardship.

    2. Upbringing. For my generation, what was most socially acceptable was to become a doctor, engineer, or businessperson. Therefore, the emphasis was on either learning science or math or becoming an entrepreneur.

    3. Hard work. With India's competitive and rote-based education system, children are forced to spend the majority of their time on their schooling. For better or for worse, it's work, work, and more work for anyone with access to education.

    4. Determination to overcome obstacles. In a land of over a billion people with a corrupt government, weak infrastructure, and limited opportunities, it takes a lot to simply survive, let alone get ahead. Indians learn to be resilient, battle endless obstacles, and make the most of what they have. In India, you're on your own and learn to work around the problems that the state and society create for you.

    5. Entrepreneurial spirit. As corporate strategist C.K. Prahalad notes in his interview with BusinessWeek's Pete Engardio (see BusinessWeek.com, 1/23/06, "Business Prophet"), amidst the poverty, hustle, and bustle of overcrowded India is a "beehive of entrepreneurialism and creativity." After observing street markets, Prahalad says that "every individual is engaged in a business of some kind�whether it is selling single cloves of garlic, squeezing sugar cane juice for pennies a glass, or hauling TVs." This entrepreneurial sprit is something that most Indians grow up with.

    6. Recognizing diversity. Indians hold many ethnic, racial, gender, and caste biases. But to succeed, they learn to overlook or adapt these biases when necessary. There are six major religions in India, and the Indian constitution recognizes 22 regional languages. Every region in the country has its own customs and character.

    7. Humility. Talk to almost any immigrant, regardless of origin, and he will share stories about leaving social status behind in his home country and working his way up from the bottom of the ladder in his adopted land. It's a humbling process, but humility is an asset in entrepreneurship. You learn many valuable lessons when you start from scratch and work your way to success.

    8. Family support/values. In the absence of a social safety net, the family takes on a very important role in Indian culture. Family members provide all kinds of support and guidance to those in need.

    9. Financial management. Indians generally pride themselves on being fiscally conservative. Their businesses usually watch every penny and spend within their means.

    10. Forming and leveraging networks. Indians immigrants found that one of the secrets to success was to learn from those who had paved the trails (see BusinessWeek.com, 6/6/05, "Ask for Help and Offer It").

    Some examples: Successful Indian technologists in Silicon Valley formed an organization called The Indus Entrepreneurs to mentor other entrepreneurs and provide a forum for networking. TiE is reputed to have helped launch hundreds of startups, some of which achieved billions in market capitalization. This was a group I turned to when I needed help.

    Top Indian journalists and academics created the South Asian Journalists Association (SAJA) to provide networking and assistance to newcomers. SAJA runs journalism conferences and workshops, and provides scholarships to aspiring South-Asian student journalists.

    In the entertainment industry, fledgling filmmakers formed the South Asian American Films and Arts Association (SAAFA). Their mission is the promotion of South Asian cinematic and artistic endeavors, and mentoring newcomers.

    11. Giving back. The most successful entrepreneurs I know believe in giving back to the community and society that has given them so much opportunity. TiE founders invested great effort to ensure that their organization was open, inclusive, and integrated with mainstream American society. Their No. 1 rule was that their charter members would give without taking. SAJA officers work for top publications and universities, yet they volunteer their evenings and weekends to run an organization to assist newcomers.

    12. Integration and acceptance. The Pew Global Attitudes Project, which conducts worldwide public opinion surveys, has shown that Indians predominantly hold favorable opinions of the U.S. When Indians immigrate to the U.S, they usually come to share the American dream and work hard to integrate.

    Indians have achieved more overall business success in less time in the U.S. than any other recent immigrant group. They have shown what can be achieved by integrating themselves into U.S. society and taking advantage of all the opportunities the country offers.

    By unanimous consent, the U.S. Senate passed a bill sponsored by Senators Schumer (D-NY), Hutchison (R-TX), and Kennedy (D-MA) that would "recapture" employment-based, third preference (EB-3) immigrant visa numbers that went unused because of processing delays during Fiscal Years 2001, 2002, 2003, and 2004. If this bill ultimately passes through Congress and becomes law as currently written, 50% of these "recaptured" numbers would be allocated to "Schedule A" occupations. Currently, the measure has passed through only the Senate. To become law, the bill would still have to pass through the House and be signed by President Bush.

    Hi,
    I am sure you all have seen the bulletin:
    F. EMPLOYMENT THIRD PREFERENCE VISA AVAILABILITY
    Demand for numbers, primarily by USCIS for adjustment of status cases, will bring the entire Employment Third preference category to the annual numerical limit by the end of June. As a result, this category will become “unavailable” beginning in July and will remain so for the remainder of FY-2008. Such action will only be temporary, however, and Employment Third preference availability will return to the cut-off dates established for June in October, the first month of the new fiscal year.

    Does this mean that all the numbers for EB3 have been used up, and there will be no more EB3 cases processed till Oct 2008, and hence the category is U;
    or
    Does it mean that they will continue to process the cases but the category is U for filing any new cases till Oct 2008?

    My pain is similar to yours buddy mine also took 6 months to file. The VB is now an monthly sadness event, even my wife is waiting for EAD, in the current time its almost impossible to get a job if one needs sponsorship read H1, despite being well qualified and having work experience. Also if we have EAD you probably would not have to go through H1B Extension (RFE's), I had to undergo this as well, fortunately my stamping was smooth. Until our day comes we just have to wait, I think the only chance is the new proposed 485 filing procedure when its implemented.

    but the proposed 2 tier system has been pushed from this december to next June 2010 (i.e 6 months) as of now, not sure whether they will come up with it at least in June...

    Lot of people are waiting to file their final step....They should start allowing to file 485 at least one year after based on their work load and based on their pre adjudication....

    Do you have your 485 approved ? If not, you are not supposed to contribute to any political campaigns. You have to be a GC holder or citizen to contribute to political campaigns. Its illegal otherwise.

    Well, I don't know what is happening with my I485. I took my Infopass appointment early morning 7.15 AM on July 2nd. My Priority date became current(PD-11/08/2004). I was quite happy that it became current. Our applications are with San Jose Local Office. We completed our interview on October 2005. At the time of our interview our priority date is not current and no visa number available. The IO said that whenever our PD becomes current they will approve our case and send the mail in card. We moved to San Jose and our case files are transferred from South Portland Maine to San Jose.

    Long story short, we went to San Jose office and told the IO that our Priority date became current and he has the VB that has all categories current.He said that he is going to pull the files out of inventory room and send to the IO the same day and he will approve it. We are aware of the fact that VB is going to change. So not sure how to take the information given to us. Will they approve as he said? or will they take it out and wipe the dust off and put it back for dust to collect again. I am disappointed, angry, helplessness. It is just 1 hour work that is all it takes to approve and I am waiting for past 2 years. Anybody in the same boat?? What can i expect from the response. What should i infer - approve or dust collection. Anyways my company is asking me to relocate to Beijing or Mainz so I will consider seriously after consulting with my wife.

    Logiclife, I had contributed before for Senator Kerry campaign in 2004 too. I don't think that is wrong is there?

    Have you given a thought or spoken to a lawyer about starting EB2 PERM when your EB3 140 is pending? After your EB2 PERM is approved, you have 6 months before interfiling your EB2 140 with your EB3 PD. I think that is long enough for your EB3 140 too be approved.

    AFAIK, this can be done with little or no risk to your EB3.

    Yes, but my current company is not willing to file a second EB2 case for me.

    Trust me your frustration is understandable......

    Guys,

    1. Consultant companies are making money by threatening to withdraw I-140 if an employee leaves the company for a better job
    2. USCIS is already making enough money on these improper denials (I would like to call it white collar extortion)
    3. Attorneys are making money on these cases

    In the end we the immigrants are the losers.

    Please make more noise on these kinds of issues concerned with I-140 withdrawls and I-485 denials, as this is becoming more and more apparent. Write blogs, spread in forums, write news letters. Go to your local congressman's office and make them aware of the situation. My local congresswoman's office is under the impression that my case is unique, but I am trying to convince them that this is wide spread by sending them the links of Ombudsman etc.,

    We need to increase the awareness.

    We do not want to get to a point where we may not utilize AC21 properly.

    I agree. Act Act act. If we do not get our acts together and simply share and discuss - nothing is going to happen.

    First thing you do is write to the Ombudsman's office. They are technically responsible to resolve case problems with USCIS.

    In your case, i think, you also have to at the least send an email to the Ombudsman.

    He is trying to spin a news and get a answer of his comfort. Guyz never stop :)

    The way DOS/USCIS behaved last couple weeks anything is possilbe - now its very easy to spin news. If someone comes here and says USCIS will not accept any applications for next two years - many of us might think "logically" and suspect the news - but last week proved that logic and USCIS/DOS dont go together.

    Anything is possible with is freaking idiotic dumbass orgnanization. Now I can feel a bit better - at least for next 30 mts. :)
