    I would like to add some points where America is loosing

    1) Less number of students are willing to come to USA as they are not seeing any future due to H1 lottery system and they have to wait for one year to apply in the 20K category as they getting rjections in applie din april as they will be graduating in june timeframe.Students are not getting jobs as there are very few companies ready to sponser them.So a long time career settlement options for students is diminishing here in USA as they cannot get GC in 2-3 year timeframe and lot of companies are not interested in wasting their resources on H1 and then applying GC for prospective students.So all these student with bright ideas are looking elsewhere like australia,germany,Uk for their education and reasearch and residency.So american is loosing their future research scientists to other countries.


    2) Career Advancement :

    Lot of H1bs converted to EAD are facing these issues, they are not able to plan for their future properly as they are not sure when they will get their GC and the moves they are making now is it acceptable to USCIS, will the next job fall into the same category as Labour or USCIS will accept the career advancment theory.So they are in jeopardy weather to take a new job and take chance or stick on to the old job.As due to this issue even though he may be dreaming of biggest technological breakthrough/Biggest supply chain enhancement/ reveloutionaly marketing spin off , he will not dare to realize his dream as he himself is not sure of his position here in US, which in turn might have helped thousands of people gaining employment and in turn helping economy.So this constant issue of settlement may force the propective employer to leave his brilliant idea and move back to his home country.

    3) Peer pressure:
    As GC applicants are not able cherish their dream in the applicable timeframe they are constantly exposed to peer pressure to look out for other avenues for their career growth and settlement.

    There is no doubt about NRIs are the prime reason for the real estate boom in India. It is tottally unbelivable that 2 bedroom flat in a normal second class town has gone to up to 40 lakes. Decent independent houses are in terms of crores in small cites. Two factors. One is foreign money and second in black money from local dadas/politicians. Also demand vs supply. The availble land is small and demand for that land is too high due to these two gropus.

    I visited one of my NRI friends house in India, where he is not going to live as he is a US citizen. His parents already won two houses and they bought another house as a investment. This house in a recent development area in a small town where there is no high tech employment is avialable; In my feeling it may not worth 5 lakes; they were selling at 45 lakes. Even if anyone ready to pay 45 lakes there is no unit is avialable; everything was sold to NRIs. No resident won the houses in that area. All the dads and mos are baby sitting the houses. Renting alos not that easy. It is tottally unbelivable. I wonder why all the NRIs buying house in India and increisng the house price? The guys working here (or any part of the world) and not going to live in India, why government should allow to buy the house and increse the price? Everyone tries to do real estate bussiness there. That is the main reason for price increase.

    Is is sad. All these NRIs are going to learn a very valuable lesson. Speculation is not a good strategy for investing. A lot learned that in the past few months here in USA. In a year we will be seeing the full blown post bubble correction in India. If one can rent an apartment for 15,000 why would one buy it for 50 lakhs. The interest alone on 50 lakhs is 50,000 every month. It is like buy and rent it and loose money. Instead why don't they deposit in a bank and get 50,000 every month:confused:

    If this guy Emilio were the CEO of a company here, and if they wasted visa numbers in October after announcing in July that they had exhaused all of them, he would be fired almost immediately.

    I guess they think that they are not answerable to anyone, so they can get away with it.There is no one to question them.

    Come on people only 11 shots to be fired. (I will take one shot, two already fired). The next person who will pull the trigger is probably a jovial person. He/she has contributed before or will contribute for the first time. He/she thinks we are a bunch of serious people, who will get the job done, but too serious for his/her company.

    That is not the case at all. To prove it, here is a joke for you, to make you pull the trigger, amused and probably laughing.

    Note: It is impossible to crack a joke and make everyone laughs. Invariably it is offensive to someone. I hope it is not the case here. Also, not everyone likes a particular joke; well the objective here is to make only one person laugh (enough to go to google and pull the trigger).     Flower campaign had similar fate - 2 to 3 truck loads of flowers just went into hospital. it was more of Lofgren involvement that helped us.

    We need to think with cool heads and execute things properly - first organize ourselves - gain support - consult our counsel - come out with proper plan of execution.

    From what I observed the action of USCIS redirecting flowers to hospital and armymen backfired. It was perceived as an insult to the brave soldiers.

    Bank Of America denied my car loan. They want only US citizens or GC holders. I have EAD and apparently its not good at all for anything. I can't even get my drivers license. The DMV is waiting for a response from DHS, until then I have to find other means to go to work.

    The other day at walmart, I paid my groceries, as usual with the credit card, so the walmart person wanted to see my ID. I showed her my EAD, she said she cannot accept that...she wants to see my Drivers License..I said it is expired and the only legal document with a photo ID is my EAD which is issued by the federal Gov...she was not convinces but said, "aahhh!!! thats okay, I trust you." and let me go...till the end she was not convinced in her mind.

    You will get your GC in 2011.
    Which state are you in? Try other means of financing for the car. Sometimes the dealers themselves have options but might be a % or two higher.
    There was a previous post regarding admisibility of EAD as one of the documents for DL. You might want to search for that post. I asume you dont have an H1b, right?

    Did anyone else received any reply - i'll post if i receive any reply.

    By the way - How about dropping a email to Ombudsman as well , saw in another thread that this approach worked ... TSC and NSC 140 sufferers can put Subject as TSC and NSC accordingly.

    Let us know how many wrote emails ( in case they couldn't get 7001 from employer) or both email and letter is good to keep the pressure ON !

    Has any of the members who sent out the letter & Form received any response from Ombudsman's office. Please post as and when you receive any response.

    I do not have updates�I wish I did. Like most people in these forums I am waiting for miracle to happen�.which probably will not happen.

    To me it seems like that the members are doing there part, i.e. sending emails, making phone calls etc. But it looks like our numbers are not enough to make a change in the policy.
    what kind of a number will really have an impact? 25K?

Looks like they've been watching those Indian vigilante movies a lot and they think that they can get away with fighting a foreign Govt agency. They'll understand what we meant when they receive a cold shoulder from USCIS :D.

    No worries mate. Just trying to help clear things but I get rebutted all the time and I'm sure they are misinterpreting me.

    I have nothing against them and as part of IV, I am just voicing an opinion which they could reject politely.

    Some of the comments on my comments are really harsh as if I am personally attacking them.

    You are right, it will be tough to dig into an agency that does approve your status here.

    They can do whatever they want and good luck to them.

    BTW, I used to have several red dots before and I don't know why they changed it to green. They still have a block on one of my IP address.

    Generally they give this update on last week of every month.

    We pay tons of fees to USCIS

    The fee we pay is very less compare to what we pay to Attorneys. And USCIS cannot drastically increase fees. And we are stuck. That is the reality.

    I think we should cut a check of same amount what we pay to attorneys.

    Guys, I have thrown out my ideas and you can take what suits you from it. As someone mentioned nothing is illegal in it. If you find something, please explain what and why.

    My conservative estimate was 100K people pulling 50K$ out..that would be 5 billions...if more comes out even better

    Fight for legislation?? Does anyone has any hopes on it still? You would get piecemeal concessions here and there..but the Indian EB immigration community as a whole gets nothing good out of it...2 year EAD, 5 yr EAD..just to wipe the tears...come on guys think out of the box.

    You argue it is not discrimination but it is law. I say the law is discriminatory and nobody wants to change it (remember the horses discussion instead of EB immigration discussion in senate), do you need any better example than this?

    Anyways, I leave it to your own judgement..and I am going ahead with my plans...I am not planning to leave the country anytime soon so I am not yet into the drastic measures I mentioned, but I sure have started the funds transfer to Indian banks, pulling out of mortgage application and moving out of US equities markets. Also, I am reducing the amount of money I pump into US economy which is currently 5K per month to ~3-3.5K per month. If it makes any difference I am making ~400K a yr from my job and other investments...

    Couldn't agree more - especially about paying for ANY college here vs. in India.

    I studied in IIT (B.Tech), got M.S. and Ph.D. from here and now a professor. My observations/opinions are as follows:

    1. Up to class XII, Indian schools are good. However, there are certain fundamental differences. Indian schools teach more material and sometimes more challenging material than U.S. schools. However, the majority of the students end up merely "remembering" and not learning; even in sciences. In general, an average student from an Indian school system would "know" more than an average student from an U.S. high-school, although in my view such "knowledge" (remembering something as a "data") is worthless. However, U.S. school system tends not to kill the curiosity and creativity of the students, which Indian system does. For good and brilliant students, however, there is no clear trend; you can get excellent and creative students from both systems.

    2. There are a handful of fine undergraduate institutes in India. The names comes to my mind are IITs, some RECs (Trichi used to be good), Jadavpur Univ., Roorkie, BHU, etc. (although IITs remain at a level higher than the rest). If you include maths, then count ISI's, which are better than IITs. The rest are just crappy. And I know how crappy can they be from my experience. I have the misfortune of teaching 100's of students who come here with an Anna University (or Osmania) B.Tech./B.E. degree in engineering, and knows absolutely nothing. And I am not exaggerating: they cannot write an elementary program in any language (apparently they learn something called "theoretical" computer programming in which they do not actually learn to program); does not know any mathematics (most cannot integrate x*exp(x); one student could not tell me what is f(0.7) by looking at a graph of x vs. f(x)) and cannot operate simple lab equipments. It is just unbelievable! Anyway, moving on.

    3. M.S. onwards, Indian Universities are bad. The only quality Institute in India in Engineering at the M.S. level is IISc. You have some more in other science related disciplines like TIFR (not sure if they give M.S. degree). IITs are not good at the M.S. level and beyond (in case you did not know: M.S. students in IITs are called "Matka"s and professors never grade M.S. students in the same scale with the B.Tech students in the fear that most M.S. student would then fail! And this indeed happened; true story.).

    There is indeed a severe dearth of qualified Ph.D. graduates in India. I had spoken with the director of Bell Labs in India and he finds it very difficult to find people who can work in R/D as a profession

    The basic problem is finding qualified teaching staffs. Professor's salaries, even in IITs, are about 7-10 times lower than what a qualified person with an equivalent degree currently gets in Industry. No wonder they cannot find faculty members (I have---well, at least had---an open faculty position offer from the director of an IIT; they are desperate for good persons). The compensation gap is too large, even considering nice faculty housing in a good place and good community for your family inside the IIT.

    By the way, no doubt there are crappy universities in the U.S. as well; especially at the M.S. level since there is no accreditation at the M.S. level.
