Guys,
I am at present on non-cap h1b and i have asked an employer to file for a new caped h1b in april 2008.
I have tentative plans of going to india in March end . In case i can't make it before april 1st back to US, can my new emplyer file for my New h1b while i am out side US...???
Is there any rule that, lates i-94 needs to be sent while aplying for h1b..???

(1) I have applied for my OPT very recently with a start date of oct1, 2007 and its in the processing stage.
(2) I am planning to apply(say by August 1st, 2007) for 140/485 concurrently in EB2-NIW category, as the PDs have become current.
Will my OPT be rejected because of the pending 485? Is it possible to file 140/485 concurrent or should I wait till my OPT is approved (by that time the PDs will no longer be current...hmmm). Your valuable suggestions are needed. Pls help me....

My AP was approved on 06/25/07 but there is an LUD on it on 08/12/07. Can somebody tell me what it can be? Thanks

� My wife came here on L2 in Aug-2007 and then applied for EAD
� She has been working on EAD since Aug-2007 with Company A
� Company A applied for her GC on 18-Aug-2009 in EB2 while she was still on L2
� Company A applied for H1 which got approved on 08-Oct-2009 till 01-Oct-2012
� We travelled out of US on 10-Dec-2009 and only gave the L2 I-94 on departure, didn�t give H1 I-94
� She got her L2 stamped from India and entered US on L2 on 03-Jan-2010
Please let us know the following:
� Is there any potential of her H1 getting cancelled because she entered back on L2?
� Do we need to get her H1 stamped immediately by going to Mexico?
� Is her L2 EAD still valid and can she work?

If you search the forums, you will find this has been the latest trend , I think for most folks who live and work in CA. Not sure about maintaining the receipt date, I had the same question, but I think the answer is not well known.

For the first time I think IV was put ahead of AILA/AILF in immigration issues when it mattered. I think finally immigration community can have sigh of relief because immigrtaion community is not represented by a bunch of attorneys who make money on immigration issues (which are legitamate or not ) but by a grass roots organization of immigrants. Congrats to IV and its members in resolving july visa bulletin fiasco. Long live IV

I have been a part of this group for a long time, and hence I thought of sharing this with you all. Although we all are here in the US, we all have our families and friends back home in India. USCIS has not extended its temporary accommodation for delays in the labor condition application (LCA) process. Earlier, USCIS agreed to accept H-1B petitions without a certified LCA, in certain situations, for a limited time. This exception was available from November 5, 2009 to March 9, 2010. The USCIS has declined to extend this exception. Accordingly, all H-1B petitions must be filed with the certified LCA otherwise USCIS will deny the H-1B petition or extension.
Hence, it again is necessary to have an Approved LCA in place for the proper location at the time of the H-1B filing. The reason the exception was not extended is that the DOL assured USCIS that LCAs are being processed within the required seven-day processing time. I applied for the I-140 and I-485 at the same time last October 9th 2009. I was requested an RFE in February of 2010 which they received back in March before the deadline. The RFE was looking for some basic info. I am still awaiting a response to the RFE or approval of the I-140. My job is currently going through tough times and there are rumors I will be laid of on April 30th. My question is that after April 9th(180 days after i filled I-140 and I-485) can i move jobs to a similar role before my I-140 is approved and if so what do i need to do.

You can file for FOIA to get it from USCIS if attorney is not cooperative. When was the labor filed? How much time it took to get approved.Just to get an idea on the timelines USCIS working on labor these days
