I don't meant to scare you but this shit usually happens when they are reconsidering the decision when the sponsoring employer withdraws your H-1B. Check with your company's/lawyer if they accidentally submitted withdrawal of your H-1B petition.

Trying to help Mother-In-Law over from China for visit. Unsuccessful w/ tourist Visa process, so now going for Green Card. Received Notice of Decision against me, unable to establish my Petitioner wife is daughter of Beneficiary Mother-In-Law. No hospital records. Previous evidence was "Notarial Certificate of Relationship." I have just received new evidence "Notarial Certificate of Birth" from civil authorities - along with affidavit from school teacher - I need to file EOIR-29, I think to call it APPEAL, OR IN THE ALTERNATIVE, MOTION TO RECONSIDER - can anyone provide a "go-by" as to what format my letter should take? Is letter format acceptable or is formal pleading format needed?
Time is of the essence, I have to file within 24 hours or give up and pursue DNA testing....

i recently got H1 Extension stamping ( Till 2011 ) and also have AP Expires in Nov 2008 .
I am working on H1 and not interested to use EAD .Do i still need to renew my EAD and AP?

just a tip not cool to hijack someone else' thread. on your question: If you are planning on being with the H1 sponsoring employer for the next few years no point renewing your EAD or AP. However they are two seperate filings. You don't need to have a valid EAD in order to apply for an AP renewal or vice versa. Hope this helps.

I am on 7th year of H1B with approved 140. 485 not filed yet.
My company is starting layoff and I am afraid I will be hit. If I switch to H4 after being laid off and found a new employer in future, is that possible to switch back to H1B without having to leave the country for a full year?
My current H1B was a three year extension based on approved 140, but I don't know if I will lose the benefit of AC21 and cannot change back to H1B once I switch to H4 since my 6 years have been used up already.

I need some clarity on this issue. I know AC21 helps switching jobs within the same field/duties, but here is my line of thought... I'm past 2yrs on my H1 and I plan to do a part-time MBA (~3yrs) after which I'd like to be open on the kind of job I do.
Now, my questions are: (1) Does switching to EAD really pause the H1 clock?
(2) Is that triggered by filling a new I-9 form alone, or by entering the US on AP, or both?
(3) I guess, I should be able to apply for a fresh H1 with a new company and switch back from the EAD to new H1, right?

Hi ,
I have been residing in the U.S. (NY) since 0ct 2007 with an H4 visa. My dad had and still has an H1B visa. I have completed my high school here in the States only and now I am enrolled as a full time student in a college (in-state tuition). Now the problem is I will turn 21 this February and I believe I will no longer be a dependent on my father's H1 visa and would be residing "illegally". In that case what should I do? I want to complete my studies and stay here in the U.S. with my family and not be deported back to my home country all alone :(
Is changing to F1 a good option for me ? I heard it could be risky? Is there any way I could have my studies going smoothly as it is now considering the out state tution under F1 would be too much...
any suggestions and help would be greatly apppreciated

I have not received the printed notice and do not want to wait for it.

I have the same situatation and called them numerous times. They say they will honour the actual date that is written on the receipt and not on the web site. When you call USCIS, you have to tell them that your receipt date is different than what is displayed on the web stie.

Any one had luck refiling I140 in EB3 for denied EB2 I140 (for same labor)?
Also is it possible to request USCIS to change an EB2 I140 denied partition to EB3 during an appeal?
It depends on several factors...
Example PERM Job requirements, reason for 140 denial...etc
