Hello Everyone,
Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year. This is apart from the salary Iam receiving right now (greater than the prevailing wage and less than LCA). Do I face any problem if I happen to go for H1B visa stamp. Could you also suggest me how to defend myself if I am asked the difference in the salary by visa officer. Thanking you all in advance.

Option1 -
Get enrolled in some university and get F1. Full time classes can give you 2-3 years of stay.
Option2-
Covert status to B1/B2. That would just buy you 6 months at the max.
Option3-
Pack up and go back to home country. Live a free life.

I have a question for the gurus. I have my GC application in process- priority date March 2006, EB2 I. When the application started my wife was on H4.
Now my wife is on H1B, and her employer has asked if she would like to have her GC processing done. Question is that can she get her application started and can I be the beneficiary on her application. The rationale behind this thought process is that considering the economic conditions, is this a safety net that one can use?

Guys,
My company is forcing everyone to fill I9 form. I have EAD but maintaining H1 status and did not use EAD. I did some research on I9 and it is no where mentioned that only people with EAD has to fill this. I need Guru's opinion on this.
I just don't want to loose my H1 status in any case.

I have an approved I-140 and have a pending I-485 filed with NSC, received date 15 Aug 07. NSC I-485 processing date was moved up to Aug 15 a few days ago.
Was wondering if anyone else with similar received dates got an approval or some form of reply from NSC?

Hello fellow IV'ans.....
Based on the volume trend shown in the USCIS website I called them and wanted to know whether my case has been pre-adjudicated or not?
Obviously I got the standard answer from the customer service saying the case is pending, I pressed on the fact that I needed to know (based on their website's information) whether the case is pre-adjudicated or not.
The customer Service rep. then forwarded the call to the National Service Center where an officer picked up the call and said "as of September, 02 2009 the case is in the Pre-Decision Unit and that they will decide on the case, but still at TSC.
I am a little confused :confused: coz haven't heard anything, anywhere, anyone talking about case being in the Pre-Decision stage. Your esteemed thoughts please....

USCIS kept on updating the total number of cases received for H-1B for FY 2009-10. However, the recent USCIS H-1B (http://www.h1b.biz/lawyer-attorney-1137085.html) cap count indicates decline in number of cases than what had been previously reported. The updated count reports the receipt of 44,400 �Regular� cap cases, by June 12, 2009 which is lesser than the prior count of 47,700, given as of May 22, 2009. There is no explanation too from USCIS for this decline in trend. Thus, this reduced number may reflect either withdrawals by employers, denials by the USCIS, duplicate filings, or an error in the prior cap counts.
As of this writing, both the Advanced Degree and Regular caps remain open. We will continue to provide updated H-1B cap count information.

Hi Folks,
Anyone have any experience with or knowledge about filing a 7th year H1-B extension per AC21 106(a) when labor certification was filed under PERM more than 365 days ago and the I-140 has NOT been filed / approved yet? There is a 12/27/2005 USCIS memo says "Guidance on this subject will be provided in a seperate memorandum", but then there is no seperate memorandum (that I could find).
My lawyers are telling me I can't file for a 7th year extension because I filed for LC under PERM, but after researching the matter, I am pretty sure they are mistaken. First, the language of AC21 states "the filing of a labor certification application on the alien�s behalf"... no distinction between ETA 750 (Traditional LC) or ETA 9089 (PERM). Furthermore, I've read various accounts on the web that state USCIS is in fact approving 7th year AC21 106(a) extensions based on PERM, but I haven't had anyone confirm that they actually did this or know first hand of someone who did.
Any help would be greatly appreciated !

Hello All,
My employer is planning to apply for my Green card (labor) next month. My employer has multiple work locations. My employer is going to apply the green card from Washington DC office location but I stay in Delaware and work from Delaware Office Location.
1. Will this impact the process in any way?
2. Do I have to move to Washington DC office to work at any point during the Green Card process? If yes, please let me know at what stage?
3. And if I have to move to Washington DC office to work then do I have to move to stay in Washington DC or can i still stay in Delaware and work from Washington DC?

I applied for H -1 extension regular processing in the month of sept 2009 in california service centre before expiration date of my H1-B(2010 Jan 22).I got RFE on DEC 18th asking for client and contractual agreements between client and vendors and i got time til Jan 29th 2010 to reply back to RFE.As i was preparing to collect all the documents to respond to my RFE ,I also applied new H 1 from same existing employer before Jan22nd 2010 in Vermont service centre.I replied back to RFE on jan 27th 2010 with client letters and letters from 2 vendors.
I got my H 1-b extension approved from California service centre on Feb 18th 2010
My question is what if my new H1 filed in vermont service centre gets rejected.Will it cause any problems to the extension that was approved.I already got my h1-b extension approval notice from uscis on FEB 18th 2010.I have'nt heard anything about my new h1 b filed on jan 21 2010 in vermont service centre.Can i continue to work on my approved extension.

my Labor Cert shows that we use job description of programmer/analyst. ETA Case shows title as "Software Engineer"
I have a job offer in Information Technology, will there be any problems if I use AC21 with the new company?
I have not yet accepted the offer.

Yesturday night, I saw Charlie Rose Show, in which he first interviewed Andi Carr and then RAHM EMANUEL Representative (D-IL)....
In the middle of conversation, Charlie asked Rahm about what Dems agree and disagree and how they will work with President. He replied that there is no all disagreement. He said Dems agree on Tax reform as well as Immigration. Then he went on to talk about favoritism to CIR.
It seems like winning the election even while being on Immigration side as well defeat of Representatives J.D. Hayworth and Randy Graf (Hardcore Immigrant Haters) have embolden Dems that Immigration is not as taboo as it was once thought. I have a feeling that they will get this done sooner than later. :)
