As of July 24, 2009, approximately 44,900 H-1B cap-subject petitions have been received by U.S. Citizenship and Immigration Services (USCIS) and counted towards the H-1B cap. Approximately 20,000 petitions qualifying for the advanced degree cap exemption have been filed. USCIS will continue to accept both cap-subject petitions and advanced degree petitions until a sufficient number of H-1B petitions have been received to reach the statutory limits. The H-1B program allows foreign nationals to work for their U.S. sponsor employer in a specialty occupation that requires theoretical or technical expertise in specialized fields. This may include scientists, engineers, and commuter programmers to name a few. The cap count for H-1B fiscal year 2010 is available at www.uscis.gov (http://www.uscis.gov).

You know CIS may issue an RFE at any point in the AOS stage..wait and see what the RFE about and respond it accordingly...I think if you are going thru an Attorney he will receive the RFE letter followup with him..

my current employer filed for my labor in march 2005, got approved in march 2007, filed I-140 in April 2005,and while I-140 was pending filed I-485 in july fiasco. In sep-2007 got intent to deny of I-140 based on A2P(ability to pay), employer filed M.T.R in October 2007. I have my fingered crossed looking at the financial statment from employer for the year 2005. chances are the MTR will be denied too. Now I have a new job offer from another employer who is willing to do new H1b for me and may be a labor petition too. the question is I want to see what comes out of the current MTR. Here is the question;
1/- if I tell the current employer to contine the process(which I dont think he will have problem with) and join the job on h1b will my I-485 status be changed or will it effects the current process?
2/- I am currently runnig on sixth year of h1b and my current visa expires in 2010 bades on the pending process with current employer. if I join the new employer on h1b what will be the H1b status will be?

I'm glad to see Immigration Voice weighing in on this one. Under some of the versions of health care reform proposals being considered by Congress, legal immigrants could be excluded for five years before they can access the Medicaid and insurance subsidies despite the fact that they pay taxes, are abiding by all of our laws and are often making critical contributions to the success of this country.

On November 27, the USCIS announced that they had received 58,900 H-1B petitions toward the 65,000 cap. So there are 6,100 numbers remaining, correct? (Update: By December 4, the USCIS had received 61,100 H-1B petitions toward the 65,000 cap.) Not exactly. We have Free Trade Agreements with both Singapore and Chile which set aside 6,800 "H-1B1" numbers for nationals of those countries. Do the math: 65,000 minus 6,800 equals 58,200. Hi,
I am a F1 PhD student The company we've been cooperating with gave me an internship offer for this summer working as an independent contractor under CPT for three months.
The univeristy international offer and the career office are both OK with this but I saw some opposite opinion online. Could someone give me a clear answer: is this legal F1 student under CPT working as independent contractor?

My situation is not very urgent, but I like to stay on top of things. Thanks in advance for your help, it is much appreciated.
My F1 visa expires on July 6 of 2011. However, I have an I-20 that permits me to stay in the United States until August 31st of 2012. The reason for this is that I came here as a master's student, but transferred to a PhD program. This is my second I-20.
I have plans to leave for India in May of 2011 and stay until end June 2011. Will it be necessary for me to apply for an F1 Visa extension? Technically I'll be back by July 6, but will it be problematic to get back without a renewed visa because there are only a few days remaining on the old visa? Again, as per the I20 I can stay legally here until August 2012. Is it difficult to renew the F1 visa? All this is almost a year from now but I'm getting quite stressed about the situation. I cannot certainly finish my degree by July 2011.
I humbly seek any information/advice anyone can provide on this. Thanks again for your time and attention.

Hello,
My original I-140 in the EB3 skilled category was denied by the TSC & is pending @ AAO because the attorney's cover letter asked for the application to considered in the professional category, instead of the skilled category.
I have been told that while that I-140 is pending at AAO I can file a new I-140 under the "Other" category &they will adjudicate that case on the same Lobor Certification. Is that accurate for the TSC?
We will also file another EB3 Skilled category I-140 which obviously will be kept in abeyance till the AAO rules on my original application.
Can an attorney please advise if I can have 2 I -140's on the same Labor Certification for different categories?

Future action items might include drafting documents and letters to support this provision. There maybe actions such as sending emails etc. However we would not be able to open a public action item unless we can have thousands of our members willing to participate in a grassroots action item. This survey intends to understand the needs of our membership for this provision and collect grassroots information.
The fact is we have a dedicated group of volunteers (and we need more) who have been trying their best to spread the message about this initiative so that a strong grass-roots support can be created leading up to launch of the public action items. So far we have around 1100 people who have responded. Based on quick calculations carried out using PERM data, it is estimated that there are at least 60K-70K EB applicants waiting to file I-485/EAD/AP (this is a very conservative estimate..the actual number could be much more). Grass-roots initiatives require time and patience and we request maximum number of impacted folks to participate actively.

Your obligations to IRS does not interfere with your GC process. This is not a "work" that you are getting paid for, outside your LCA.

I am doing my second masters from a university with a valid i20. I have a CPT till the end of Aug 2008. I have a approval notice for H1B with start date of OCT 1 2008.
I am planning to discontinue the course from Fall (Starts sep 1st) 2008. Because there is only one month gap between Fall Semester and H1b start, is it possible i stay in the US without taking any courses at the university. i do not mind not working if i have an option to stay back in US till oct 1st.
i am trying to avoid a hefty fee for the whole semester, i need to fill the gap from SEP 1st 2008 to OCT 1st 2008
