I work for one of the biggest software companies which deals with PERM cases a lot. However, my case got audit notice and I'm really confused now.
My PD is Jan-19-2009 and I received my audit notice in 11/2009, and we replied in 12/2009. I just learnt today that it might be very likely to take more than 2 years to clear such a case and there is possibility to be denied.
I'm very worried that I might lose my PD, is it really true that my case won't be cleared for at least another year?

One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.
Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

Hi,
I have a pending I-140 (RD March 12, 2007) and I-485 (PD Sept 2001, India EB-3, Current in April 2008).
My wife and I, currently have EADs. My wife has been offered a job and they need a Green Card when she joins in May 2008.
Is there a way to expedite the processing of I-140 and I-485, so that we do get our Green Cards in next month or so?

conservative columnist and former Bush speechwriter David Frum would like to see three more concessions on the DREAM Act to get conservatives to agree to the bill - http://andrewsullivan.theatlantic.com/the_daily_dish/2010/12/middle-ground-on-dream.html: Here would be my three main suggestions: 1) Lower the age of entry into the US. Even the new versions of the law extend amnesty to people who entered the US up to age 16. That allows too many people who entered on their own impetus rather than as part of a family group and too many people whose first language will never be English. Id lower to 12, to...

I read this in the I-485 application:
"The check or money order should be made payable to the Department of
Homeland Security except:
--If you live in the U.S. Virgin Islands and are filing this
application freely, make your check or money order
payable to the ''Commissioner of Finance of the Virgin
Islands.''
--If you live in Guam and are filing this application there,
make your check or money order payable to the
''Treasurer, Guam.''
Good luck in re-filing!
Should the check made out to "Department of Homeland Security"?
Should the checks stapled with each form (485, 131, 765) or kept on top of the packet?

I sent my I-485 application to USCIS on July 31, 2007. On their website they logged the following message:
"Application Type: I485, APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS
Current Status: Case received and pending.
On September 24, 2007, we received this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS, and mailed you a notice describing how we will process your case....."
Why is the received date Sep 24, 2007 when the application was most likely received on Aug 1, 2007?

I am currently a H1B visa holder engaged to a US citizen. We are planning on going to India soon for the formal engagement ceremony and getting married early next year.
I had two points of concern:
1. Upon returning after the engagement, I will still be on H1B (since the wedding is going to be a bit more than 90 days after the official engagement so the K1 visa is not an option), will this cause issues at port of entry?
2. After marriage, we plan to go abroad for our honeymoon (we likely won't have time to file anything with immigration before our return): how should I proceed upon reentry then or is this even advisable since I'll be returning on an H1 but be married to a US citizen?
Any advice would be greatly appreciated, thanks.

The National Foundation for American Policy has released a policy brief regarding the new GAO report on the H-1B program and notes that the GAO blows a torpedo through the common complaint that the H-1B program is just a way to bring in cheap guest workers. NFAP GAO H-1B report

i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.
thanks.

Tomorrow President Obama meets with members of Congress to talk about kick starting immigration reform efforts. I'm curious about what readers would tell President Obama if they were in the room. Share in the comments section what you would tell the President and members of Congress about immigration reform efforts this year.

Hi,
I am currently on H1 visa while I have my wife here with me on H4 Visa. Currently my I-140 application is under processing. My wife is about to apply for a job which will result her H4 visa to be converted into H1. Could anybody suggest whether this will have any effect on our application status?
Thanks in Advance.

Those who follow immigration politics closely know that the finding in a new America's Voice Bendixen poll of 1,100 Hispanic voters that more than 3/4 consider immigration to be a major issue for them is true. But for many anti-immigrant members of Congress, there's a case of wishful thinking going on - that Hispanic voters only consider immigration a minor issue and will vote on other issues instead. Or an even less realistic assumption that Latino voters actually feel the same way as them and want to see immigration reform fail. That thinking failed miserably in 2006 and 2008 as...
